Bit9ja Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Bit9ja (“Bit9ja”, “we”, “our”, or “us”), governing your access to and use of the Bit9ja mobile application, website, APIs, and all related services (collectively, the “Platform”). By accessing or using the Bit9ja Platform, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you must not use the Platform.

2. About Bit9ja Services

Bit9ja is a digital financial services platform offering, among other things:

  • Cryptocurrency Services: Buying, selling, receiving, and transferring supported digital assets through wallets provided on the Platform.
  • Gift Card Services: Trading supported gift cards at displayed rates.
  • Bill Payment Services: Payment of airtime, mobile data, electricity, cable TV, and similar services using fiat balances.

All services collectively are referred to as the Bit9ja Services.

3. Eligibility and Account Registration

To use Bit9ja, you represent and warrant that:

  • You are at least 18 years old and legally capable of entering into a binding contract.
  • You have created an account using accurate, complete, and up-to-date information.
  • You are not prohibited from using the Platform under any applicable laws.
  • If acting on behalf of a company or entity, you are duly authorized to bind that entity.
  • Your use of Bit9ja complies with all applicable laws, including AML, CFT, and anti-fraud regulations.

Bit9ja reserves the right to refuse, suspend, or terminate accounts that do not meet eligibility requirements.

4. Identity Verification (KYC)

To comply with legal and regulatory obligations, Bit9ja may require you to provide identity and verification information, including but not limited to:

  • Government-issued identification
  • Proof of address
  • Bank or payment details
  • Transaction and usage data

Failure to provide or maintain accurate verification information may result in restricted access, suspension, or termination of your account.

5. User Responsibilities and Account Security

  • You are responsible for safeguarding your account credentials, including your password, PIN, and any authentication details.
  • You must not share your login credentials with third parties.
  • Bit9ja will never request your password or PIN via phone calls, emails, or social media.
  • You must notify Bit9ja immediately if you suspect unauthorized access or suspicious activity.

Bit9ja shall not be liable for losses arising from unauthorized access caused by your failure to secure your account.

6. Transactions and Irreversibility

a. Cryptocurrency Transactions

All cryptocurrency transactions are final and irreversible once confirmed on the blockchain. Bit9ja cannot cancel, reverse, or refund completed crypto transactions.

b. Bill Payments and Gift Cards

Before confirming any payment or trade, you are responsible for verifying all details. Errors caused by incorrect input may not be refundable. Where applicable, disputes may need to be resolved with third-party service providers.

7. Fees and Rates

Applicable rates, fees, and charges will be displayed on the Platform before you confirm any transaction. By proceeding, you agree to the displayed rates and fees. Bit9ja reserves the right to adjust fees based on market conditions, operational costs, or regulatory requirements.

8. Prohibited Use

You agree not to use the Platform to:

  • Engage in illegal, fraudulent, or deceptive activities
  • Violate AML, CFT, or sanctions laws
  • Provide false or misleading information
  • Abuse promotional programs or attempt chargebacks
  • Upload malicious software or interfere with Platform security
  • Harass, threaten, or defame Bit9ja, its employees, or users
  • Infringe intellectual property rights

Violation of this section may result in immediate account suspension or termination.

9. Suspension and Termination

Bit9ja may suspend or terminate your access to the Platform, with or without notice, if:

  • You breach these Terms
  • We detect suspicious or high-risk activity
  • Required by law or regulatory authorities
  • Necessary for security, compliance, or risk management

Termination does not relieve you of obligations incurred prior to termination.

10. No Financial Advice

Bit9ja does not provide financial, investment, legal, or tax advice. All information provided on the Platform or through communications is for informational purposes only. You acknowledge that cryptocurrency and digital assets involve significant risk and that you are solely responsible for your financial decisions.

11. Disclaimer of Warranties

The Bit9ja Platform and Services are provided on an “as is” and “as available” basis. Bit9ja does not warrant that the Platform will be uninterrupted or error-free; transactions will always execute without delays; or the Platform will be free from security threats. Use of the Platform is at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Bit9ja shall not be liable for:

  • Loss of profits, data, or digital assets
  • Market fluctuations or price volatility
  • Network delays or blockchain failures
  • Cyberattacks beyond reasonable control
  • User errors or third-party service failures

13. Conversion of Digital Assets

Bit9ja reserves the right, where necessary, to convert digital assets within user wallets to alternative supported assets to manage operational, regulatory, or market risks. Where practicable, users will be notified.

14. Data Protection and Privacy

Bit9ja processes personal data in accordance with applicable data protection laws. Details on how we collect and use data are outlined in our Privacy Policy, which forms part of these Terms.

15. Analytics and Tracking

Bit9ja may use analytics tools to improve service performance and user experience. Such tools operate in accordance with applicable privacy laws and our Privacy Policy.

16. Amendments to These Terms

Bit9ja may revise these Terms at any time. Updated versions will be published on the Platform. Continued use of the Services after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
